1. Who we are

This website, bcknife.com (the "Site"), is operated by CCAT, Inc. d/b/a Bear Claw Knife & Shear, a Delaware corporation ("Bear Claw," "we," "us," or "our"). Our store is located at 4706 N. Midkiff Rd, Suite 11, Midland, Texas 79705. You can reach us at 432-253-3660 or info@bcknife.com.

By using the Site or placing an order, you agree to these Terms and Conditions (the "Terms"). If you do not agree, please do not use the Site.

2. Eligibility and age requirement

You must be at least 18 years old to buy from us. By placing an order, you confirm that you are at least 18 and legally able to enter into a binding contract. We may ask for proof of age and may cancel any order if we cannot verify it.

3. Knife laws and your responsibility

Knife laws differ by country, state, county, and city. Some places restrict or ban certain knives, such as automatic (switchblade) knives, balisongs, double-edged or dagger-style blades, and knives over a certain blade length.

You are solely responsible for knowing and following every law that applies to buying, owning, carrying, and using the items you order where you live and where you use them. By placing an order, you confirm that owning the items is legal where they will be delivered.

We may refuse, cancel, or refund any order that we believe may violate an applicable law, or that we are not willing to ship to a particular destination. We do not give legal advice about knife laws.

4. Products and descriptions

We try to describe and photograph our products accurately. Colors, finishes, handle materials, and natural materials (such as wood, bone, or horn) can vary from the photos. Manufacturer specifications are provided by the manufacturer. We do not warrant that every description is complete or error-free.

5. Prices, availability, and order acceptance

All prices are in U.S. dollars. Prices and availability can change without notice. Your order is an offer to buy. We accept it when we ship the item or perform the service, not when you receive an order confirmation email.

If an item is listed at an incorrect price because of a typographical or system error, we may cancel the order and refund any payment, even after we send a confirmation. We may limit quantities and may refuse orders that appear to be placed by resellers or that we suspect are fraudulent.

6. Payment

Checkout is processed through our e-commerce platform, Lightspeed, with card payments handled by our payment processor, Global Payments (Cayan). We do not receive or store your full card number. We do not currently offer buy-now-pay-later financing. By submitting payment, you confirm that you are authorized to use the payment method.

7. Sales tax

We collect sales tax where the law requires us to. Currently this means Texas sales tax on orders delivered in Texas. If you are outside Texas, you may owe use tax to your state, and paying it is your responsibility.

8. Shipping

• Shipping cost. Shipping is free on orders of $100 or more (before tax). Orders under $100 ship for a flat $10.
• Same-day shipping. In-stock orders placed by 4:00 p.m. Central Time, Tuesday through Friday, usually ship the same day. Orders placed after the cutoff, or on Saturday through Monday, usually ship on the next shipping day. Holidays, carrier delays, and high order volume can affect these times. Delivery dates are estimates, not guarantees.
• Where we ship. We ship to addresses within the lower 48 states. We do not ship to Alaska, Hawaii, U.S. territories, or international destinations. Some carriers and destinations restrict certain knives, and we may decline to ship those items to those places.
• Risk of loss. Title and risk of loss pass to you when we hand the package to the carrier. If a package is lost or damaged in transit, contact us within 7 days of the expected delivery date and we will help you file a claim with the carrier.

9. Returns, exchanges, and refunds

• Return window. Returns are permitted within 30 days of purchase.
• How to start a return. You must complete the return form under your orders in your Bear Claw account. Your request will be processed within three days. Once the return has been approved, carefully package the merchandise and include a copy of the return form. We will provide you with a prepaid shipping label for your return.
• Condition. All returned items must be in new condition, unused, and all packaging and paperwork included. We will not accept items returned used, damaged, or with damaged or missing packaging.
• Refunds. Once we receive your merchandise, we will inspect it and issue your refund minus return shipping costs. Return shipping costs may be waived for defective items. Refunds can only be made to the original form of payment. The original cost of shipping, if any, will not be refunded.
• Engraved items. Engraved items are personalized and cannot be returned (see Section 12 if we made an engraving error).

Nothing in this section limits any rights you have under a manufacturer's warranty.

10. Warranties

Many products we sell carry a warranty from their manufacturer. Warranty claims for those products are handled under the manufacturer's terms, and we are happy to help point you in the right direction.

EXCEPT FOR ANY MANUFACTURER WARRANTY AND ANY WARRANTY THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW, PRODUCTS AND SERVICES ARE PROVIDED "AS IS." TO THE EXTENT THE LAW ALLOWS, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

11. Mail-in sharpening service

• Sending your items. Follow the instructions on the Site when you ship knives or tools to us. Pack them securely with the edges covered. You are responsible for the item and shipping cost until it reaches our store. We recommend insuring the package.
• Return shipping. Return shipping follows our standard shipping rule: free on orders of $100 or more, and a flat $10 under $100.
• Condition of items. Sharpening removes a small amount of steel. Items that are chipped, bent, cracked, rusted, heavily worn, or have loose handles may not sharpen to a like-new edge, and some damage may only become visible during sharpening. We may decline to sharpen any item, or contact you before doing extra work. Some items, such as certain serrated or specialty edges, may not be serviceable. We sharpen knives and scissors. • Our responsibility. We take reasonable care with your items. If we damage an item through our own negligence, our responsibility is limited to repair or replacement with a comparable item. We are not responsible for pre-existing damage or defects, or for items lost or damaged by the carrier on the way to us.
• Unclaimed items. We hold unclaimed items for thirty (30) days after we finish the work. If we cannot reach you or collect payment within those thirty (30) days, the item is considered abandoned and we may dispose of it.

12. Engraving service

• You are responsible for the spelling, wording, and layout of your engraving text. Please double-check it before you submit your order. We engrave what you provide.
• We may refuse engraving requests that are offensive, that may infringe someone else's trademark or copyright, or that are not technically possible on the item.
• Engraved items are personalized and cannot be returned or exchanged unless we made an error. If we made an error, we will re-engrave or replace the item at our cost.
• Placement, depth, and appearance can vary with the item's material and finish.
• Engraving may add time to processing and shipping, so same-day shipping does not apply to engraved orders.
• Engraving an item may affect the manufacturer's warranty or its return eligibility.

13. Safe use

Knives and sharpening tools are sharp and can cause serious injury. Use, store, and carry them responsibly and keep them away from children. We are not responsible for injury or damage caused by misuse, careless handling, or modification of a product.

14. Accounts

If you create an account, keep your password confidential. You are responsible for activity on your account. Tell us promptly if you believe someone has used your account without permission.

15. Site content and intellectual property

The Site's content, including text, photos, graphics, logos, and the Bear Claw Knife & Shear name, belongs to CCAT, Inc. d/b/a Bear Claw Knife & Shear or its licensors and is protected by intellectual property laws. You may not copy, reproduce, or use it for commercial purposes without our written permission. Product names and brands belong to their respective owners.

16. Acceptable use

You agree not to misuse the Site. That includes attempting to interfere with its operation, gaining unauthorized access, scraping it with automated tools, placing fraudulent orders, or using it for any unlawful purpose.

17. Reviews and submissions

If you post a review, comment, or photo, you give us a non-exclusive, royalty-free, perpetual license to use, display, and reproduce it in connection with our business. You confirm that you have the right to share it. We may remove any submission at our discretion.

18. Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY LAW, BEAR CLAW AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SITE OR ANY PRODUCT OR SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID FOR THE PRODUCT OR SERVICE THAT GAVE RISE TO THE CLAIM.

Some states do not allow certain limitations of liability, so some of these limits may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law, including any rights you have under the Texas Deceptive Trade Practices Act that cannot be waived.

19. Indemnification

You agree to defend and indemnify CCAT, Inc. d/b/a Bear Claw Knife & Shear against any claims, losses, or expenses (including reasonable attorneys' fees) that arise from your violation of these Terms or of any law, including knife laws, or from your misuse of any product.

20. Governing law and disputes

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute arising out of these Terms, the Site, or your purchase will be brought exclusively in the state or federal courts located in Midland County, Texas, and you consent to their jurisdiction. Before filing a claim, please contact us so we can try to resolve the issue informally.

21. Other terms

• Changes. We may update these Terms from time to time. The version posted on the Site when you place an order applies to that order.
• Severability. If any part of these Terms is found unenforceable, the rest stays in effect.
• Entire agreement. These Terms, together with our Privacy Policy and any policies posted on the Site, are the entire agreement between you and us about the Site.
• No waiver. If we do not enforce a provision, that does not waive our right to enforce it later.
• Events beyond our control. We are not responsible for delays or failures caused by events beyond our reasonable control, such as weather, carrier disruptions, or supplier shortages.
